Proposed Amendments to the Law of Georgia “On Copyright and Related Rights”

Following the decision of the Constitutional Court of Georgia in Case No.2/1/877, in which the court held that some of the provisions of the law of Georgia ‘On Copyright and Related Rights’ ran counter to the Constitution of Georgia, a package of amendments was proposed in the Parliament of Georgia to facilitate the implementation of the court’s decision and rectify these inconsistencies. 
 
In summary, the amendments make the following provisions: 
 
  • Organisations that manage property rights on a collective basis will have the right to request information from individuals and legal entities (including state organisations and institutions) about manufacturing and import of equipment and physical carriers; 
  • The processing of received information in a way that breaches the established procedure will be subject to administrative liability.
