The Georgian National Competition Agency, in the direction of the protection of consumer rights, established the fact of violation of the commitment agreement by "Pixel Touch" LLC (PixL MobI ). The case concerns - on the part of informing the customer, on the part of the merchant, the improper implementation of the communication trade policy, both during on-site trading and through the Facebook page.
In accordance with the legislation, the obligation to inform the consumer means that through any platform, commercial communication between the merchant and the customer - the offer to purchase specific goods/services must be fully and clearly delivered in accordance with the law. Regardless of whether the customer has the opportunity to enter into an instant contractual relationship with the merchant.
According to the Agency's decision, the trader was found to have violated the conditional obligation contract due to non-fulfillment and was ordered to restore the violated rights of consumers within one month and to adjust his trade policy to the relevant requirements of the law. In case of non-fulfillment of the obligation imposed by the Agency, the Agency will act within the scope of the powers granted by the legislation.
For information: In the direction of the protection of consumer rights, from November 2022 – to September 2023, the National Competition Agency has received 401 applications, and a case study has been started on 227 applications. In the mentioned period, the Competition Agency signed 72 commitment agreements in favor of the consumer on 110 cases. The 27 facts of violations of the rights of the consumer group were confirmed -in 41 cases, and in 5 cases were not confirmed.
Due to non-fulfillment of the obligation imposed by the Agency, 4 traders were fined in 15 cases.
