Draft Law: If a foreign national does not cultivate their land, he/she will have to sell it

“If a foreign person does not cultivate the land, he/she will have to sell it” – this is an amendment incorporated into the draft law on agricultural land ownership, which was prepared by the parliamentarian Otar Danelia. According to the draft law, foreign nationals have a right to own the land if it is inherited or they have acquired rights to the legitimate ownership of agricultural land. In order to acquire rights to the legitimate ownership of agricultural land, the foreign national will need a decision to be made by the Georgian government. He/She has to provide an investment plan to the government. If the conditions in the plan are not fulfilled or completed, the foreign national is required to sell the plot of land within 1 year. In addition, a foreign national who has a permanent residency or investment residence permit is obliged to alienate their agricultural land within two years if he/she does not cultivate it. This does not apply to homestead plots of land.
