GCCA declares complaint by “E.P.J“ inadmissible

The complaint submitted by “E.P.J“ LLC was considered inadmissible by the Georgian Competition and Consumer Agency. The complaint alleged a violation of Article 11(3) of the Law of Georgia on Competition, which pertains to unfair competition.

Upon conducting a comprehensive admissibility assessment, the Agency determined that the complainant did not establish a sufficient level of reasonable suspicion to support the alleged infringement. Furthermore, the complainant’s request to prohibit the importation of TYQ-branded headlights by the respondent exceeded the Agency’s statutory mandate and fell outside its scope of legal competence. Accordingly, in the absence of a legal basis to initiate proceedings, the Agency determined that launching an investigation was not justified.

According to Article 11(3) of the Law, any action of undertakings that contradicts the norms of business ethics and infringes the interests of consumers shall be regarded as unfair competition.

The GCCA issued inadmissibility decisions on 6 complaints.
