The first session of the newly elected parliament announced on November 25 and its recognition of the powers of the members of parliament is a clear and gross violation of the Constitution of Georgia and the Rules of Procedure of the Parliament of Georgia, - this is stated in a statement issued by the non-governmental organization "Transparency International - Georgia".
In addition, the organization explains the reasons and the norms of the law that are violated by holding the first session of the parliament.
"On November 25, 2024, members of the ruling party will gather in the legislative body to recognize the powers of the newly elected parliament.
The President of Georgia has not convened the first session of the parliament. In addition, the constitutionality of the elections of October 26, 2024 and, accordingly, the legality of the election of 150 members has been challenged in the Constitutional Court. According to Article 38 of the Constitution of Georgia, the first session of the Parliament is called by the President. According to the same article, the Parliament acquires full powers from the moment of recognition of the powers of two-thirds (100 members) of the members of the Parliament. According to Article 86 of the Rules of Procedure of the Parliament, the resolution of the Parliament on recognition of the powers of the members of the Parliament shall not include the name of a person whose legality of election as a member of the Parliament has been appealed to the Constitutional Court. It should be noted that the parliamentary elections held on October 26, 2024 were held against the backdrop of intimidation, coercion, total control of citizens and mass violations of the secrecy of the vote. Monitoring organizations and political parties filed hundreds of lawsuits in general courts demanding the invalidation of the election results in individual precincts and districts. The announcement of the election results was followed by a large protest among the population, which continues to this day. The election results were not recognized by the international community. The European Commission announced that it would send a special mission to Georgia to investigate election violations. Two lawsuits have been filed with the Constitutional Court demanding that the elections be declared unconstitutional. The President of Georgia and 30 members of Parliament have appealed to the Constitutional Court for violating the secrecy of the elections and the right to universal, free elections. The President of Georgia has not convened the first session of the Parliament, the legitimacy of which, and therefore the legality of the election of its members, should be the subject of consideration by the Constitutional Court.
