JSC Institute IGH does not agree with the decision of the Road Department penalty related to the closing of the Gori tunnel.
According to the contract signed between the Road Department and Ibolia Ltd, Ibolia Ltd was obligated to notify both the Department and the supervising company IGH regarding the closing of the above-mentioned tunnel.
Despite the above-mentioned circumstances, such a notification was not sent and the closing of the Gori tunnel from the western to eastern direction at km 88 of the road and the redirection of traffic to the Gori Tunnel Bypass road was started execution without notification.
"“Ibolia” Ltd notified “Institut IGH” regarding the closing of the tunnel only after the actual closing of the tunnel, and Institut IGH send the above information immediately to the Roads Department, but the reception of this was not confirmed due to the delay (the works have already started).
Moreover, Ibolia Ltd did not fulfill the responsibility of placing information signs regarding the ogoing works on the road.
Hence, JSC Institut IGH has not violated the terms and conditions of their contract and has appropriately executed all of the activities. Thus, the appointment of a penalty is unreasonable.
