Georgian National Competition Agency, completed the study of the case and established the fact of the violation of the Law of Georgia on the Protection of Consumer Rights, in Batumi, in the food service sector, in relation to two traders - "Kizil 2023" and "Grill Food".
As a result of the case study implemented by the Agency, it was established that in the facilities belonging to "Kizil 2023" and "Grill Food", the reference (food) menu is drawn up and placed only in a non-state language. Accordingly, customers entering food facilities do not have the opportunity to receive information in the state language, clearly and comprehensible.
In accordance with the legislation, consumers have the right to request and receive information in the state language, and not knowing it cannot be a reason for refusing to provide services.
According to the Agency’s decision, within one month, the trader was instructed to conform its trade policy to the requirements of the relevant articles of the law. In the case of the failure to execute or the improper execution of a decision made by the Agency, a fine will be imposed on the trader.
In the process of studying the case, in order to determine and specify the relevant circumstances, for not providing the information requested by the Agency within the established period, a fine of 500 GEL was imposed on "Grill Food".
The National Competition Agency started the study of the case on the basis of the letter from the "Batumi Municipal Inspection". The case concerns the service provided by 11 traders only in a foreign language in public food facilities, cafes and bars. The investigation of the case against 9 traders is ongoing. The decision made by the Agency will be public and accessible to everyone.
