The Georgian National Competition Agency has completed its investigation in the fast food service sector and established the fact of unfair competition.
The case was concerned to the study of the case initiated on the basis of the complaint of “Tsereteli Mexican” LLC - against “Tsereteli Mexican Hot Dog” LLC and “Mexican Tsereteli N1” LLC.
As a result of the investigation, the facts of the use of trademarks and appearance of the applicant company were confirmed. According to the Agency's decision, two companies ("Mexican Hot Dog on Tsereteli" and "Mexican on Tsereteli N1") were imposed appropriate financial sanctions and ordered to eliminate the violation of the law. The parties have the right to appeal the Agency's decision to the Tbilisi City Court.
In 2023, the Agency completed 5 investigations into possible abuse of a dominant position, unfair competition, concerted practice, and possible restrictions of competition by state administrative bodies. In 1 case, the violation was not established, in 1 case, the study was ended at the request of the applicant, in 3 cases, the violation was established and appropriate recommendations were provided. The investigation covered the auto fuel, tobacco, maritime shipping, auto technical inspection and construction/infrastructure services markets.
In the same period, a decision of inadmissibility was made in 6 cases. At the present, the Agency is conducting an investigation process in relation to 4 issues - in the direction of pharmacy, online sales of cinemas ticket, parking lots and food products markets.
