State Procurement Agency Places Imedi L on Blacklist

The State Procurement Agency has placed insurance company Imedi L on its blacklist following a dispute over a 2019 tender announced by Georgian Railway for health insurance services for its employees. Imedi L was one of five bidders and was disqualified in October 2019 over documentation issues. The company had submitted the lowest bid, and a multi-million-lari contract would have been signed with it had it not been disqualified. The tender was ultimately terminated in January 2020 without selecting a winner.

Georgian Railway said Imedi L had provided inaccurate information regarding its relationships with medical provider institutions, listing Sena-Medi and Life 2012 among its providers despite the relevant contractual relationships not being in place when the bid was submitted. Imedi L disputed the assessment, arguing that the tender conditions did not require written agreements with providers to be signed at the time of submitting the bid. The company said cooperation with Life 2012 had been agreed through electronic correspondence.

The dispute went through several court instances. Tbilisi City Court rejected Imedi L’s claim in 2022, a decision upheld by the Court of Appeals in 2024. On July 29, 2026, the Supreme Court declared the company’s cassation appeal inadmissible. The Procurement Agency said the legally binding court decisions confirmed that information submitted in the tender documentation did not correspond to the actual circumstances.

The agency’s commission issued its decision on September 4, 2026, finding grounds to place Imedi L on the blacklist. According to the agency, such registration applies when a bidder engages in bad-faith conduct to obtain the right to conclude a contract. The agency also determined that there were no grounds to issue a warning instead. The decision can be appealed within one month of its official notification.
